Lomi — Terms of Service

These Terms of Service (“Terms”) govern your use of the Lomi mobile application (“Lomi,” “the Service,” “we,” “us,” or “our”). By creating an account or using Lomi, you agree to these Terms.

If you don’t agree, please don’t use Lomi.

1. Eligibility

You may use Lomi only if:

You are at least 18 years old.
You are located in the United States.
You can form a legally binding contract under your jurisdiction.
You have never been previously banned from Lomi.

If you do not meet these requirements, you may not create an account or use the Service.

If we learn that a user is under 18, we will terminate their account and delete their data.

2. Your Account

You are responsible for:

Providing accurate and current information.
Maintaining the confidentiality of your authentication credentials.
All activity that occurs under your account.
Notifying us immediately if you suspect unauthorized access.

You may not:

Create more than one account per person.
Create an account on behalf of someone else without their permission.
Misrepresent your age, identity, photos, or location.
Use someone else’s photos in your profile.

We reserve the right to suspend or terminate accounts that violate these rules.

3. Acceptable Use

You agree NOT to:

Harass, abuse, threaten, or intimidate other users.
Use the Service to send unsolicited commercial messages or spam.
Post or share content that is illegal, deceptive, sexually explicit, violent, hateful, or harmful.
Impersonate any person or entity.
Use bots, scrapers, or automated tools to interact with the Service.
Attempt to access another user’s account, profile, or private messages without permission.
Reverse-engineer, decompile, or otherwise extract source code from the app.
Use the Service to commit fraud, money laundering, or any criminal activity.
Solicit money or financial information from other users.
Promote prostitution, escort services, or any commercial sexual activity.

Violation of these terms may result in immediate account suspension or termination.

4. User-Generated Content

You retain ownership of content you post on Lomi (photos, moments, messages, etc.).

By posting content, you grant Lomi a non-exclusive, royalty-free, worldwide license to host, store, display, and distribute that content solely for the purpose of operating the Service.

You represent and warrant that:

You own the content you post or have permission to use it.
Your content does not infringe anyone else’s intellectual property, privacy, or other rights.
Your content complies with these Terms.

We do NOT use your content to train AI or machine learning models, for advertising, or for any purpose outside of operating Lomi.

5. Content Moderation

Lomi reserves the right to:

Remove or hide any content that violates these Terms.
Suspend or terminate accounts that violate these Terms.
Take action on reports submitted by other users.

We use both automated systems and human review to enforce these Terms.

If your moment or content is hidden or your account is suspended:

We will notify you in-app where reasonable.
You can email lomiteam@outlook.com to appeal.

Repeated violations may result in permanent account termination without refund.

Reporting

You can report another user’s profile or moment content using the in-app reporting tools. We review reports and take appropriate action, which may include hiding content, suspending the reported user’s moments, or terminating their account.

Blocking

You can block another user. Blocking is symmetric — blocked users cannot see you in feeds, and you cannot see them. You can manage your block list in your Profile tab under Blocked users.

6. Payments and Purchases

Lemons and Golden Lemons

Lemons and Golden Lemons are in-app credits used for sending tosses (a way to express interest in another user).

Lemons and Golden Lemons are purchased through the Apple App Store, processed via RevenueCat.
Purchases are non-refundable except where required by Apple’s terms or applicable law.
Lemons have no cash value and cannot be transferred or exchanged for cash.
If we suspend or terminate your account for a violation of these Terms, any unused Lemons are forfeited.

For refund requests, contact Apple directly through your App Store account. We cannot process refunds outside of Apple’s system.

Subscriptions

If Lomi offers subscription products in the future, the terms of each subscription (price, renewal, cancellation) will be disclosed at purchase. Subscriptions auto-renew unless cancelled.

7. Account Termination

Termination by You

You can delete your account at any time:

In-app: Settings → Help & Support → (deletion option, coming soon)
By email: lomiteam@outlook.com

After deletion:

Your profile becomes invisible to other users immediately.
Your data is deleted within 30 days (see Privacy Policy for details).
Unused Lemons are forfeited.
Existing matches and messages are removed.

Termination by Us

We may suspend or terminate your account if:

You violate these Terms.
We are legally required to.
The Service is discontinued.
We believe in good faith that termination is necessary to protect Lomi, other users, or the public.

We will provide notice where reasonable, except in cases of urgent safety concerns.

8. Disclaimers

Lomi is provided “as is” and “as available.” We make no warranties about:

The Service being uninterrupted, error-free, or secure.
The accuracy of profiles or content posted by other users.
The behavior of other users either inside or outside the app.
Whether you’ll find a match or romantic partner.

You are responsible for evaluating other users before meeting them. Lomi does not conduct criminal background checks on users. Use caution when meeting anyone you’ve connected with online.

9. Limitation of Liability

To the maximum extent permitted by law, Lomi and the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

Loss of profits or data.
Personal injury caused by other users.
Emotional distress.
Property damage.

Our total liability for any claim related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions don’t allow limitations on certain warranties or liability, so portions of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Lomi, the Operator, and any associated parties from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from:

Your use of the Service.
Your violation of these Terms.
Your violation of any third party’s rights.
Content you post.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws provisions.

Any disputes arising from these Terms or your use of Lomi shall be resolved in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of those courts.

You agree to resolve disputes individually and waive any right to participate in a class action against Lomi.

12. Changes to These Terms

We may update these Terms from time to time. When we do:

We will update the “Last updated” date at the top.
For significant changes, we will notify users via in-app message or email.
Continued use of Lomi after changes constitutes acceptance of the updated Terms.

If you disagree with any changes, your only remedy is to stop using the Service and delete your account.

13. Severability and Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

Our failure to enforce any right or provision is not a waiver of that right or provision.
